Regulation (EU) 2023/1230 is the new European regulatory framework for machinery, published in the Official Journal of the EU on June 29, 2023. It will definitively replace Directive 2006/42/EC as of January 20, 2027. What changes compared to Directive 2006/42/EC
The transition from directive to regulation is not merely formal. Regulation 2023/1230 introduces substantial changes that impact production, documentation, and conformity assessment. The main innovation is direct application in all Member States without national transposition, which eliminates interpretative discrepancies. The definition of “machinery” is expanded to include software-based systems that perform safety functions, including products that lack only the loading of specific software at the time of placing on the market.
