Machine Safety – Legislative Decree 81/2008 Articles 70-72.
CE marking is not an absolute guarantee of safety for the Employer. This is perhaps the most important thing companies need to know about machine safety: the presence of CE marking declares the product’s conformity to the product directive, but does not exempt the Employer from the responsibilities provided by Legislative Decree 81/2008. 81/2008. The obligations provided by Articles 70, 71, and 72 of Legislative Decree 81/2008 81/2008
Articles 70, 71, and 72 of Legislative Decree 81/2008 regulate the safety requirements, correct use, and maintenance of machines, plants, and equipment in the company. The main obligations for the Employer are:
- Exclusive use of equipment conforming to the requirements provided by Annex V (pre-CE machines), Annex VI (safety of use), and Article 70 of Legislative Decree 81/2008 81/2008
- Selection of equipment suitable for the work to be performed, correct installation, and adaptation of safety measures to the best currently available protection technology.
- Regular, routine, and extraordinary maintenance, documented and updated
- Management of technical modifications and updating of accompanying documentation
- Verification of equipment conformity, even if already CE marked, to the intended use in the specific context
- Compliance with specific obligations for lessors and lenders
- Adequate training of operators for each piece of equipment used
CE-marked equipment: the residual responsibility of the Employer
A common mistake in companies is to believe that CE marking exhausts all safety responsibilities. This is not the case. The Employer must still verify that the equipment is suitable for the specific use intended in their company, that the technical documentation is complete and updated, that operators are adequately trained, and that maintenance is performed according to the manufacturer’s specifications. Pre-CE equipment: Annex V
Equipment manufactured before the entry into force of European product directives is not required to have CE marking. To be used in the company, it must meet the minimum safety requirements established by Annex V of Legislative Decree 81/2008. 81/2008.
